Messaging Privacy Policy

CONEXON CONNECT, LLC (“Conexon Connect”) is committed to maintaining your privacy. This Messaging Privacy Policy and Agreement (“Messaging Privacy Policy”) specifies the personal information that you must provide in order to receive messages from Conexon Connect’s messaging program (“Messaging Program”), such as updates about service availability at your address, scheduling service installation, and outage notices (“Messages”) and governs how we treat this personal information. Conexon Connect’s messaging service includes but is not limited to Messages in the form of US mail, email, and text messages (e.g., SMS and MMS) (“Messaging Service”).

For additional details regarding the information collected by Conexon Connect if you purchase service from us, please see the Conexon Connect Service Privacy Policy, available at www.conexonconnect.com. This document is Conexon Connect’s entire and exclusive Messaging Privacy Policy, and it supersedes any earlier version.

PLEASE READ THIS MESSAGING PROGRAM PRIVACY POLICY CAREFULLY. YOUR CONSENT TO THE TERMS OF THIS MESSAGING PROGRAM PRIVACY POLICY CREATES LEGAL OBLIGATIONS FOR YOU AND CONEXON CONNECT. IF YOU DO NOT AGREE WITH THE TERMS OF THIS MESSAGING PRIVACY POLICY, PLEASE OPT OUT OF THE MESSAGES YOU ARE RECEIVING. SEE SECTION 8 OF THIS MESSAGING PRIVACY POLICY FOR FURTHER INFORMATION ON HOW TO OPT OUT.

  1. Consent. By entering and submitting your information in the Sign-Up Tool, you enroll in Conexon Connect’s Messaging Program and expressly agree to this Messaging Privacy Policy and consent to the collection and use of your information. If you do not consent to the terms of this Messaging Privacy Policy, please withdraw consent by opting out of the Messages you are receiving. For further information on how to opt out of Conexon Connect’s Messages, please see Section 8 of this Messaging Privacy Policy.


  2. Choosing to Opt-In. Consent to receive automated Messages is the consumer’s choice and is not a condition for purchase or service enrollment. You can opt out of receiving Messages any time. For further information on how to opt out of Conexon Connect’s Messaging Program and Messages, please see Section 8 of this Messaging Privacy Policy.


  3. Information Collected. We collect various information from and about you in the Messaging Program, including information you directly provide when you consent to receiving Messages from us. For example, when you complete the form in the Sign-Up Tool, we receive your name, phone number, email address, your preferred method of contact and, if applicable, your preferred subscription packages. When you submit your information in the Sign-Up Tool, we also receive a timestamp of when the form was submitted and a copy of the IP address from which the Sign-Up Tool was submitted. We may also collect information about you using cookies or similar technologies. Cookies are pieces of information that are stored by your browser on the hard drive or memory of your device. We also collect any data related to Messages and the Messaging Program, including but not limited to your messaging history and any information included in those messages.


  4. Use of Information Collected. We may use your information to deliver, analyze, maintain, and support the Messaging Program. We may also use your information to enhance the Messaging Service features and customize and personalize your experience with the Messaging Program.


  5. Protection of Information Collected. We take a variety of physical, technical, administrative, and organizational security measures based on the sensitivity of the information we collect to protect your information against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access. However, this Messaging Privacy Policy should not be construed in any way as giving business, legal, or other advice, or warranting the security of information provided by or submitted to Conexon Connect as fail proof. Due to the nature of Internet communications and evolving technologies, we cannot provide, and disclaim, assurance that the information you provide us will remain free from loss, misuse, or alteration by third parties who, despite our efforts, obtain unauthorized access.


  6. Sharing of Information. We will not rent, sell, or otherwise disclose your information to unaffiliated third parties without your express consent, except in the following limited circumstances:

    a. Conexon Connect Vendors. We may employ other companies to perform functions on our behalf, such as hosting or maintaining the Conexon Connect platform, website, or mobile app; providing services related to Conexon Connect’s operations; collecting information; responding to and sending electronic mail; or other functions necessary for Conexon Connect’s business. Through the normal course of business, we may need to share your information with these companies (collectively, "Vendors"), but will only provide Vendors with information necessary to perform their functions.

    b. Agents and Affiliates. We may share your information to agents, employees, or contractors of Conexon Connect and its affiliates as necessary for the purpose of performing services on behalf of Conexon Connect. All such agents, employees, contractors, and affiliates who have access to such information are required to keep the information confidential and not use it for any other purpose than to carry out the services they are performing for Conexon Connect or as otherwise required by law.

    c. Question of Harm. Conexon Connect may reveal your information to attorneys, private investigator organizations, or law enforcement agencies if Conexon Connect believes: (a) that you are in risk of harm from another; or (b) that you are harming or interfering (or will harm or interfere) with others or otherwise violating legal rights.

    d. Legal. Conexon Connect will reveal your information, to the extent Conexon Connect reasonably believes it is required to do so by law.

    e. Transfer of Site. Conexon Connect shall be entitled to transfer to a third-party the information it collects, including any of your information collected for the purpose of Messages, in connection with a sale of all or substantially all of the assets of the business entity responsible for the information under its Service Privacy Policy, provided the acquiring third party has agreed to safeguard your information.


  7. Retaining Information. Conexon Connect will retain your information for as long as you participate in the Messaging Program, and as needed to comply with applicable legal obligations.


  8. Opting-Out. You can opt-out of receiving Marketing Messages from Conexon Connect (“Opt-Out Notice”) at any time by providing Conexon Connect with opt-out notice via the following methods:

    E-Mails - To stop receiving Messages from Conexon Connect via email, please click the “Unsubscribe” button at the bottom of the email. You may also email [email protected], including the word “STOP” or “UNSUBSCRIBE” and include the email address you wish to unsubscribe. Please allow up to ten (10) business days to process your request.

    Text Messages - To stop receiving Messages from Conexon Connect via text message, reply “STOP” to any text message you receive from Conexon Connect. You may also email [email protected], including the word “STOP” or “UNSUBSCRIBE” and include the mobile number wish to unsubscribe. Please allow up to ten (10) business days to process your request.  Upon opting-out of receiving text messages from Conexon Connect, you consent to receive a final text message confirming your opt-out request, regardless of the method you use to revoke consent to receive Messages via text (e.g., via text, email, or phone call). If you unsubscribe and then later re-subscribe using the same mobile number, you acknowledge and agree that Conexon Connect may send you text messages relating to any previous orders, even if those orders were pending before you re-subscribed.

    Do Not Contact List - To opt out of receiving all Messages from Conexon Connect and to request placement on Conexon Connect’s internal “do not contact” list, please call (844) 542-6663 or email Conexon Connect at [email protected] with the contact information you would like placed on the internal “do not contact” list (e.g., name, phone number, email address, mailing address).

    Please note the Opt-Out Notice is only applicable to Messages. If you purchase Conexon Connect service, you will continue to receive transactional notices concerning your services (e.g., bill reminders, outage notices, account notices, etc.), even if you have opted-out of Conexon Connect’s Messages.

  9. Dispute Resolution. Any disputes with you regarding the Messaging Program and Messaging Services will be addressed in accordance with the Dispute Resolution procedures specified in Section 9 of the Messaging Terms and Conditions.
